Terms of Service.

The agreement between you, your organisation, and Kaam Hire — covering subscriptions, the shared candidate database, billing, and acceptable use.

01 Acceptance & the agreement

These Terms of Service (the “Terms”) form a binding agreement between Kaam Hire — a product operated by Kaam.com (the “Company”, “we”, “us”) — and the organisation on whose behalf you sign up (the “Customer”, “you”).

By signing up, clicking “Create my workspace”, or using any part of the service, you confirm that you have authority to bind your organisation and that you accept these Terms and the Privacy Policy.

If you do not accept these Terms, do not use the service.

02 What Kaam Hire is

Kaam Hire is a subscription-based applicant tracking system (ATS) and hospitality talent database hosted at hire.kaam.com. We provide:

03 Your account

To use Kaam Hire you must register an account with a valid work email address and verify that email via the link we send. You agree that:

04 Plans & subscriptions

Kaam Hire is offered as a paid subscription in three billing cycles. Current pricing is published on the pricing page; the headline rates as of the last-updated date are:

All prices are quoted in Indian Rupees (INR) and are exclusive of Goods and Services Tax (GST), which is added at the applicable rate at the time of payment. Kaam Hire may from time to time offer promotional or founding-customer pricing, the conditions of which will be presented at checkout.

05 Account activation

Signup is free of charge. After you submit the signup form you will receive an email containing a verification link. You must click that link within 48 hours to activate your workspace; an unverified signup will not be able to sign in and may be deleted.

Once activated, your workspace is ready for use. Access to the paid features of Kaam Hire — including revealing candidate contact details, AI-assisted matching at scale, and the full set of ATS tools — requires an active subscription on one of the plans described in Section 4.

06 Billing, renewal & cancellation

Paid subscriptions are processed through Razorpay Subscriptions. By subscribing you authorise Razorpay to charge your nominated payment method (UPI, debit / credit card, or net banking) for the subscription amount, plus applicable GST, at the start of each billing cycle.

Auto-renewal

Subscriptions renew automatically at the end of each cycle for the same billing period at the then-current published price, unless you cancel before the renewal date.

Cancellation

You may cancel at any time from your account settings or by writing to rishi@kaam.com. Cancellation takes effect at the end of your current billing cycle — you retain access through that date. Auto-renewal is stopped immediately on cancellation.

Failed payments

If a charge fails we will retry as permitted by Razorpay. If payment is not successful within 7 days the subscription will be marked past-due; if it remains unpaid for a further 14 days the account may be suspended or downgraded, at our discretion.

Tax

GST receipts are issued by Razorpay after each successful charge and are available from your account.

07 Refunds

Subscription fees are non-refundable. We do not provide partial refunds for unused time in a billing cycle, downgrades within a cycle, or cancellations made after a renewal charge has been processed.

In the limited cases where a charge is made in error (for example, a duplicate charge), we will refund the affected amount on request.

08 The shared candidate pool

The Talent Pool is shared across all Kaam Hire Customers. By using the service you acknowledge and agree that:

We do not provide exclusivity over candidates in the Talent Pool. Other Customers may simultaneously evaluate or hire the same candidate.

09 Resume unlocks & quotas

Each plan includes a fixed quota of resume unlocks (revealing a candidate’s contact details) for the billing cycle:

Unused unlocks do not roll over to the next cycle. Quotas reset at the start of each billing cycle. We may, at our discretion, offer paid add-on packs for unlocks beyond the included quota.

10 Acceptable use

You agree that you will not, and will not permit any user of your account to:

We may investigate and take action (including suspension or termination) against any use that we reasonably believe violates these rules.

11 Your data & ownership

Data that you upload, create, or generate inside your workspace — including your own uploaded candidates, jobs, pipeline records, notes, communications, and reports — is “Customer Data”.

You retain ownership of your Customer Data. You grant Kaam Hire a non-exclusive, royalty-free, worldwide licence to host, store, process, and display Customer Data solely to operate, secure, support, and improve the service for you.

On termination of your account you may request an export of your Customer Data within 30 days. After that period we may delete or anonymise Customer Data in accordance with our retention practices described in the Privacy Policy.

12 Our intellectual property

All rights, title, and interest in the Kaam Hire platform, including its source code, design system, content, trademarks, brand elements, the Talent Pool database structure (independent of individual candidate records), and any feedback you provide, remain the property of Kaam.com.

Nothing in these Terms transfers any IP rights to you other than the limited licence to use the service while you have an active subscription.

13 Third-party services

Kaam Hire relies on third-party processors to operate. By using the service you acknowledge that data is shared with these sub-processors as required:

Details and the scope of data shared with each is set out in the Privacy Policy. We are not responsible for any third-party site or service that you choose to integrate or link to from your workspace.

14 Suspension & termination

We may suspend or terminate your access to the service, with or without notice, if you (i) materially breach these Terms, including the acceptable-use rules, (ii) fail to pay a renewal charge that remains unpaid after the grace period, (iii) use the service in a way that exposes Kaam Hire or other Customers to legal or security risk, or (iv) if required to do so by law or by an order of a competent authority.

You may terminate at any time by cancelling your subscription. On termination you stop being charged for future cycles; you retain access through the end of the cycle already paid for.

15 Disclaimer of warranties

The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Kaam Hire disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that:

16 Limitation of liability

To the maximum extent permitted by law, neither party is liable to the other for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with these Terms or the service, even if the party has been advised of the possibility of such damages.

Kaam Hire’s total aggregate liability for all claims arising out of or relating to these Terms or the service, in any 12-month period, will not exceed the fees paid by you to Kaam Hire in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded under Indian law, including liability for fraud or for death or personal injury caused by negligence.

17 Indemnity

You will indemnify, defend, and hold harmless Kaam Hire and its directors, officers, employees, and agents from any third-party claim, demand, loss, damage, or expense (including reasonable legal fees) arising out of or related to (i) Customer Data you submit, (ii) your or your users’ breach of these Terms, (iii) your misuse of the service, or (iv) your violation of any applicable law, including data-protection or labour-law obligations owed to candidates.

18 Governing law & disputes

These Terms are governed by the laws of India. The parties submit to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, for the resolution of any dispute arising out of or in connection with these Terms, without prejudice to either party’s right to seek urgent injunctive relief in any other competent forum.

19 Changes to these terms

We may update these Terms from time to time. When we make a material change we will update the “Last updated” date at the top of the page and, where appropriate, notify Customers by email or in-app message at least 14 days before the change takes effect. Continued use of the service after the change takes effect constitutes acceptance of the revised Terms.
